We conduct both assertion based and opportunistic based licensing activities.  These activities encompass all forms of intellectual property, but focus on patent and technology licensing, as well as trademark and brand licensing.  All opportunities, assertion-based or opportunistic-based, are analyzed and reviewed from several perspectives, including: 

  • Legal:  This review will determine the scope of protection that has been or can be afforded to represented intellectual assets.  Further, we identify any limitations that the company may have with respect to its position vis-à-vis a licensee and eventual outbound licenses (in the event a third party has rights with respect to portions of the underlying technology).
     
  • Technical:  With respect to assertion based patent and technology licensing, this review will determine how easily a third party can engineer around our clients patents and, as well as prioritize the probability that a third party is currently infringing a client's patent.  With respect to opportunistic-based licensing, our technical review will quantify how "productizable" a specific technology is and the required integration/modifications necessary to ready the technology for the marketplace. 
     
  • Financial/Economic:  This review helps determine the pricing and potential revenue with respect to specific opportunities.  This analysis ensures that we prioritize our efforts against the most profitable opportunities.  In addition, we identify the implementation and on-going costs associated with each concept to generate traditional financial measures such as discounted cash flow analyses and payback period.
     
  • Marketing:  We perform a marketability study and develop marketing strategies with respect to specific opportunities.  Key marketing issues likely include time-to-market, target customer base, distribution channels, competition and cannibalization of existing products/services.    
After completing the steps above, we make recommendations and commence execution of the action plans with respect to pursued technology, brands and related intellectual property, ensuring that all plans are prioritized against client goals and objectives and resource and time constraints.

If successful, our clients enter into relationships with multiple licensees and other business partners (including venture capitalists, engineering firms, etc.).  LAVA Group will perform on-going relationship management to ensure:

  • Revenues are maximized. 
  • Our client is well represented. 
  • Intellectual assets protected. 
  • Technology upgrades understood and provided. 
  • Reports and payments are timely provided to the client.
