Our IP Services Approach

Every intellectual property situation we confront is different. We are asked by clients to sell or license their portfolios or, in the alternative, help them acquire portfolios. Each situation relates to a different technology, unique risks and liabilities, short term or continuing efforts and varying objectives.  The only thing in common in these efforts is that each comes with a multitude of obstacles and sensitivities.

All divesture opportunities are analyzed and reviewed from several perspectives, including:

  • Marketing:  We perform a marketability study and develop marketing strategies with respect to specific opportunities.    

  • Legal:  This review will determine the scope of protection that has been or can be afforded to represented or targeted intellectual assets. 

  • Technical:  With respect to assertion based licensing, this review will determine how easily a third party can engineer around our clients patents and, as well as prioritize the probability that a third party is currently infringing a client's patent.  With respect to opportunistic-based licensing, our technical review will quantify how "productizable" a specific technology is and the required integration/modifications necessary to ready the technology for the marketplace.
  • Financial/Economic:  This review helps determine the pricing and potential revenue with respect to specific opportunities. 

After completing the steps above, we make recommendations and commence execution of the action plans with respect to pursued patents and concepts, ensuring that all plans are prioritized against client goals and objectives and resource and time constraints.  If successful, our clients enter into relationships with multiple licensees and other business partners (including venture capitalists, engineering firms, etc.).
